General Terms and Conditions

General information

The "GeoW4" association operates a ticket shop for the organisation and handling of events. For example, free tickets, pitch tickets (camping tickets in the festival area) and event tickets (admission tickets for the event without the possibility of return) can be purchased in the ticket shop. A merchandise shop is operated for the purchase of associated geocoins, pathtags and various fan articles (e.g. T-shirts). The shops can be accessed via the associations website for specific events.

Scope of application

The GTCs on which the contracts between the "Geo W4" association and the customers are based apply equally to the merchandise shop and the ticket shop. Customers are both consumers (B2C) and entrepreneurs (B2B).

Service description

Offers in the online shops are not legally binding and are valid while stocks last. The prices shown include VAT. The "Geo W4" association reserves the right to change dates, which may occur at short notice due to weather conditions. There is no maximum or minimum number of participants for the event. The "Geo W4" association reserves the right to introduce participant restrictions for certain tickets that require restrictions for capacity reasons. This applies in particular to tickets for motorhome and caravan pitches, tent pitches, workshops and lectures. The event tickets are only valid once and will be validated upon entry by authorised persons of the "Geo W4" association.

Conditions Ticketshop

Customer account

There are no customer accounts in the ticket shop. Customer data must be re-entered for each order. Orders are linked to a valid e-mail address. The same e-mail address is required to return tickets.

Payment options

  • Credit card (Visa, Mastercard, American Express, Discover, JCB, Diners Club, China UnionPay)
  • Debit card
  • Google Pay, Apple Pay, eps Überweisung, giropay

These payment options are processed via the payment provider "Stripe" (https://stripe.com/at/payments).

  • Prepayment

The payment deadline is 14 days after invoicing. The SEPA credit note must be visible on the club account. Late payments are invalid and will invalidate the tickets. The amount will be refunded.

  • Cash payment directly at the event on site is only possible if this option is indicated accordingly on site.

The payment methods may vary depending on the availability of the items. The "Geo W4" association reserves the right to deactivate or activate certain payment methods at its own discretion (without observing deadlines or explicitly informing customers).

Booking process in the ticket shop

Tickets for a specific event are added to the "Ticket basket" or "Cart". The "Continue" button takes you to the "Checkout". In the checkout, the billing details are entered and a payment method is selected. By explicitly selecting two buttons ("tick box"), the customer confirms that they have read and accepted the terms and conditions and the privacy policy. The "Order with obligation to pay" or "Buy now" button triggers a chargeable order. The "Book tickets" button triggers the processing of the order.

With the payment methods "Payment in advance" and "Cash payment at the event", the customer receives an email with the invoice and further payment instructions. With the payment method "Payment in advance", the event tickets are sent by e-mail after the invoice amount is visible on the club account and the cashier manually initiates the dispatch. In the case of the "cash payment at the event" payment option, the tickets are handed over on site (step by step) and also sent by e-mail.

When selecting the payment option "Online payment", the customer will be redirected to the page of the payment provider Stripe, through which the payment process takes place. This process must be completed within 30 minutes, otherwise the order will be automatically cancelled. Once the order process has been successfully completed, the customer will receive an order confirmation with invoice and, within a short time, the tickets ordered. If the payment process with the payment provider Stripe fails or is cancelled prematurely by the customer, the order that has already been placed for technical reasons will be cancelled and the payment process must be carried out again.

Payment fee: A fee of 3% is charged for online payments via the payment provider Stripe ("payment fee"). This fee is commercially rounded to two decimal places. Vouchers (discount codes) reduce the item total including the fee (referred to as the "subtotal" in the ticket basket). Customers can view this information at any time via an info symbol in the shopping basket (click on "Payment fee" in the checkout).

Conditions Merchandise Shop

Customer account

There is a registration option for customers in the merchandise shop. Customer data is retained here and can be used for a new order.

Payment options

  • Prepayment

Payment deadline: The payment deadline is 14 days after invoicing. The SEPA credit note must be visible on the association account. Payments received after the payment deadline are invalid and will result in the order being cancelled. The amount credited to the association account will be refunded.
Fees: All costs and fees incurred for the payment shall be borne by the client. Differences to the invoice amount due due to fees charged to the payee will be demanded without exception. If the payer does not meet the demand, the order will be cancelled and the amount remitted. In this case, any fees will also be charged to the original debtor.

Cash payment directly at the event on site is only possible if this option is indicated accordingly on site.

The payment methods may vary depending on the availability of the items. The "Geo W4" association reserves the right to deactivate or activate certain payment methods at its own discretion (without observing deadlines or explicitly informing customers).

Merchandise shop booking process

The booking process in the merchandise shop is different from that in the ticket shop. There is a registration option for customers (customer account). When ordering via the shopping basket, it is possible to access the customer account, create a new customer account or order without registering. After entering the customer data, the shipping method and the payment method, the order can be checked and the order is finalised by clicking on the "Order with obligation to pay" button. An e-mail will be sent to the specified address with the details of the ordered goods and the payment details (bank details).

Merchandise shop delivery times

It is only possible to collect items yourself during the event during the opening hours of the shop on site or the Infopoint.

Performance deficiencies

The general warranty regulations apply to the products in the merchandise shop (replacement of defective goods; price reduction; cancellation of contract).

The following points apply equally to the ticket shop and merchandise shop.

Retention of title

The "Geo W4" association reserves the right of ownership until the purchase price has been paid in full. In the event of a bona fide acquisition by a third party, the assignment of the purchase price claim against the third party shall be deemed to have been agreed in advance.

Compensation for damages

Participation is at your own risk. No liability claims can be made against the organiser, especially not during the event itself or when camping in the designated areas.

Contestation of errors

The "Geo W4" association accepts no liability for any pricing, typing, printing or calculation errors, either in the online shops or at the events. Errors on the part of customers are to be asserted in accordance with general civil law standards.

Cancellation rights

The "Geo W4" association explicitly informs customers of their cancellation rights in accordance with the Austrian Distance Selling Act. The Distance and Off-Premises Selling Act stipulates special requirements for contracts concluded electronically outside of business premises. Pursuant to Section 8 (2) FAGG, a trader must ensure that the consumer expressly confirms when placing the order that the order is linked to a payment obligation. If the ordering process requires the activation of a button or the activation of a similar function, this button or function must be clearly labelled with the words "order with obligation to pay" or a similar, unambiguous formulation that indicates to the consumer that the order is associated with an obligation to pay to the trader. If the trader does not fulfil the obligations under this paragraph, the consumer shall not be bound by the contract or his contractual declaration.

The "Proceed to checkout" button and the "Buy now for a fee" button in the online shop fulfil the mandatory requirements of the FAGG and the contract is concluded when the customer clicks the button. The confirmation of receipt by email only has declarative effect. This is also the time at which the warranty period and any withdrawal and cancellation periods begin.

Cancellation period and exception to the right of cancellation for distance contracts

Pursuant to Section 11 (1) FAGG, a consumer may withdraw from a distance contract or a contract concluded away from business premises within 14 days. It is not necessary to give reasons. The exercise of the right of cancellation is informal in accordance with Section 13 (1) FAGG, i.e. the declaration of cancellation is not bound to any particular form. However, in accordance with Section 18 (1) (10) FAGG, a consumer does not have the right to withdraw from distance or off-premises contracts for services in the areas of accommodation other than for residential purposes, transport of goods, rental of motor vehicles, delivery of food and beverages and services provided in connection with leisure activities, provided that a specific time or period is contractually stipulated for the fulfilment of the contract by the entrepreneur. Accordingly, there is no right of cancellation for all services provided by the "Geo W4" association in connection with leisure activities. This applies in particular to tickets for events, which is why all orders for tickets are binding and the customer is obliged to pay for them without exception.

Return of free tickets

Free tickets can be returned at any time up to the start of the event. Returns can be made using the e-mail address used for the order. (Procedure: enter e-mail address - e-mail sent via link - return tickets via the link provided).

Documentation of the event

As part of the events organised by the "Geo W4" association and in particular at the event venues, photos and videos are taken for documentation purposes and for reporting in the press (newspaper reports, association website) and social media (e.g. Facebook, Instagram, etc.). Photos and/or videos may be taken by members of the association or external photographers working on behalf of the "Geo W4" association. By registering for the event, the customer acknowledges that photo and video material depicting the customer will be used for the above-mentioned purpose without receiving any remuneration.

Contract language:

German

Applicable law:

Austrian law

Place of jurisdiction:

at the consumer's domicile, habitual residence or place of employment.

Application of the GTC:

The "Geo W4" association would like to expressly include its GTC in the contractual relationships with its customers. Customers can download and save or print out the GTC.

Severability clause:

"Geo W4" endeavours to draft its GTC as clearly and comprehensibly as possible. Should a contractual provision in the GTC used be unclear or incomprehensible and therefore invalid in accordance with Section 6 (3) KSchG, only this individual provision shall be wholly or partially invalid. On the other hand, the contract between the "Geo W4" association and the customer remains valid. The statutory provisions shall replace the invalid contractual provision; the remaining provisions shall remain unaffected. For the sake of good order, it should be noted that void provisions shall be subject to a contractual amendment based on dispositive law or the hypothetical will of the parties. Subsidiary consideration must be given to the practice of fair dealing.
